TERMS AND CONDITIONS (T&C)
1. General Provisions
These Terms and Conditions (hereinafter: T&C) govern the contractual relationship between:
Statistical Consulting and Data Analysis Leonardo Miljko
Statistical Consultant and Educator
(hereinafter: Consultant)
and
the client or contracting party
(hereinafter: Client).
The Consultant provides the following services:
- statistical consulting
- methodological consulting
- tutoring and training in statistics and data analysis
- assistance in the interpretation of statistical results
- technical assistance in the use of statistical and analytical software.
Services may be provided via:
- online communication platforms (e.g. Zoom, Teams, TeamViewer or similar tools)
- electronic communication
- or other agreed forms of cooperation.
If no separate written agreement has been concluded between the parties, these Terms and Conditions shall apply.
2. Legal Nature of the Activity
The Consultant operates as an independent sole proprietor.
All services are provided personally by the Consultant.
The contractual relationship is established directly between the Client and Leonardo Miljko as Statistical Consultant and Educator.
3. Nature of the Services
The Consultant provides consultative, methodological and educational services in the field of statistics and data analysis.
In the context of tutoring or consulting:
- statistical analyses are carried out together with the Client
- the Client operates the software independently.
The Consultant does not write academic papers on behalf of the Client.
The services constitute methodological consulting and educational support.
4. Use of Statistical and Analytical Software
During consulting or tutoring sessions, the following software may be used, among others:
- IBM SPSS Statistics
- NVivo
- PSPP
- R
- Stata
- Microsoft Excel
- Microsoft Word
- Microsoft PowerPoint
- or other programs used for data analysis and presentation.
The Consultant does not provide software licenses.
The software is used exclusively by the Client on the Client’s own computer and under the Client’s own license.
The Client is responsible for complying with the licensing conditions of the respective software providers.
The Consultant provides methodological advice and educational support regarding statistical methods and software usage only.
5. Responsibility for Data
The Consultant assumes no responsibility for:
- the quality of the data
- the accuracy of the data
- the completeness of the data.
Responsibility for data collection, data quality and lawful use of the data lies solely with the Client.
6. Academic Responsibility of the Client
The Client bears sole responsibility for:
- the content of their academic or scientific work
- compliance with academic integrity rules
- the use of results obtained through consulting.
The Consultant assumes no responsibility for potential violations of academic regulations or scientific standards.
7. No Guarantee of Academic Success
The Consultant does not guarantee:
- the success of a scientific or academic work
- acceptance of the work by a supervisor, university or academic institution
- acceptance of the applied statistical methodology.
The Consultant assumes no responsibility for academic evaluations.
8. Methodological Advice
The Consultant provides methodological advice in the field of statistics only.
The Consultant shall not be liable for:
- scientific conclusions made by the Client
- interpretations of statistical results
- decisions made on the basis of statistical analyses.
9. Limitation of Scope of Services
The Consultant’s services are limited to the agreed scope of consulting.
The Consultant assumes no responsibility for:
- the practical implementation of statistical results
- decisions or actions taken based on the consulting provided.
10. Confidentiality
The Consultant and the Client agree to treat all information exchanged during the cooperation as confidential.
This obligation remains valid for a period of five (5) years after the termination of the cooperation.
11. Fees and Payment
Fees for services are agreed individually between the Consultant and the Client.
Unless otherwise agreed:
- 50% of the fee is payable in advance
- the remaining balance is payable after the service has been provided.
The Consultant reserves the right to suspend services until payment has been received.
12. Cancellation of Appointments
If an appointment is cancelled less than 24 hours before the scheduled time, the Consultant reserves the right to charge the full agreed fee.
13. Retention of Results and Unpaid Services
The Consultant retains all rights to analyses, materials and results until the agreed payment has been made in full.
In the event of non-payment, the Consultant has the right to:
- suspend work
- retain the results of the analysis
- refuse delivery of results or materials until full payment has been received.
The Consultant may also use anonymized or generic examples of analyses, methodological procedures, graphs or statistical tables for:
- educational purposes
- scientific purposes
- demonstration or promotional purposes.
No personal data or identifying information of the Client will be published.
14. Limitation of Liability for Statistical Errors
Statistical analyses are based on the data provided by the Client and on statistical model assumptions.
The Consultant assumes no liability for:
- errors resulting from incomplete or incorrect data
- different methodological approaches
- alternative scientific interpretations of statistical results.
Statistical analyses represent a professional assessment based on the available data and knowledge at the time of analysis.
15. No Guarantee of Completeness of Advice
The Consultant does not guarantee that all possible statistical methods, models or analytical approaches have been considered during the consulting process.
16. Copyright
All materials, documents, examples and teaching materials created by the Consultant are protected by copyright.
Reproduction or distribution without the written permission of the Consultant is not permitted.
17. Right to Refuse Service
The Consultant reserves the right to refuse orders or terminate cooperation without providing a reason.
18. Language and Translations
The legally binding version of these Terms and Conditions is the Croatian version.
Versions in other languages (including German or English) are provided for informational purposes only and may have been created using automated translation tools.
In the event of discrepancies, the Croatian version shall prevail.
19. Websites
The main informational website of the Consultant is:
Other websites associated with the Consultant, including but not limited to:
may contain additional or shortened information.
In case of discrepancies, the content published on www.StatistischeBeratung.de shall be considered the reference version.
20. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany shall apply.
Where legally permissible, the place of jurisdiction shall be Landau an der Isar, Germany.
